Terms and Conditions:
It is your responsibility as the real estate agent and/or broker to review all the conditions presented in these terms and conditions. We reserve the right to amend these Terms and Conditions at any time without notice to you.
Please note that all costs stipulated in these terms and conditions are calculated in Canadian currency.
Ordering a Service:
“48 Hrs Post Installation”
- All orders will be completed within 48 hrs once payment has been received excluding Weekends and Holidays.
- It is the responsibility of the real estate agent and/or broker, to ensure we have all necessary materials or instructed details prior to Installation.
- All Signs and Riders are to be dropped off at the warehouse location prior to the date of installation unless prior arrangements have been arranged
- We use the address you provide on the order, so it is your responsibility, as the real estate agent or broker, to guarantee the information provided is correct. If it is not correct, you, as the real estate agent and/or broker, are responsible for all charges incurred as a result of your negligence. These charges are non-negotiable.
- When ordering a service, you are agreeing to full payment for the service provided.
- When ordering a removal service, it is your responsibility, as the real estate agent and/or broker, to guarantee that the post(s) and sign(s) are left out, and reasonably visible for the driver upon arrival. It is your responsibility, as the real estate agent and/or broker, to ensure that our posts are not damaged. A post in a garage or locked backyard may result in an additional fee on your invoice. A damaged or missing post will result in a replacement charge of $100 which the real estate agent and/or broker is responsible for fully paying.
Return trips:
- If return trips to a property are needed, the real estate agent and/or broker agrees to all additional charges for “return-trip” services.
Obstructions / Nowhere to install:
- Property Post Durham will not install on City Property
- The Real estate agent and/or Broker is responsible for notifying Property Post Durham of any circumstances where a property does not have a lawn. The Real estate agent and/or broker is required to share where they would like the sign to be installed.
Lost / Damaged Post:
- In the event that our posts are missing (cannot be located) there is a non-negotiable $100 fee automatically applied to your account. An email will be sent out to you to inform you if we have been unable to retrieve the post. If you are able to identify the location of the post, it is your responsibility to submit a “pick-up” order. In the event that we successfully retrieve the post, the real estate agent and/or broker will be credited the $100.00 charge.
- In an event where our posts are damaged, but not limited to beyond repair, the real estate agent and/or broker will be fully responsible for a $100 replacement post cost.
Signs and Storage:
- All signs are subject to wear and tear damages or weathering from being up at listings. Property Post Durham will not pay to replace signs that have been damaged from basic and ordinary usage.
- If the real estate agent and/or broker has changed brokerages Signs from you previous brokerage will have to be arranged for pick up to keep as much storage space as possible.*Please note if your previous signs are not picked up by an agreed-upon date. Property Post Durham reserves the right to dispose of any materials
- In the event that the Sign Installers are doing an inventory of outdated signs, and no instructions have been given to the Sign Installers, the old brokerage signs will be disposed of.
- We offer indoor storage for your signs free of charge. However, Indoor space is very valuable so after one Year if you have not used our Service we will be in contact with you to arrange a pick up for your signs. We welcome your return at any later point. *Please note that if we can not contact you with the contact information provided, Property Post Durham reserves the right to dispose of any materials
- It is the responsibility of the real estate agent and/or broker to pay for all charges associated with sign disposal.
- Agents and/or brokerages are responsible for keeping Property Post Durham updated on their current marketing materials. If multiple branded signs are being stored in the warehouse it is the agent and/or brokerage’s responsibility to alert us to which sign is to be used.
- The quality of signs stored by Property Post Durham will be monitored by Property Post Durham and shared with the Real estate Agent and/or Broker. If materials are deemed to be in poor quality, it is the agent’s responsibility to direct the warehouse to dispose of those materials. Anything that remains in storage may go out on service at any time.
Installations;
- Property Post Durham will not install a post on city property, and/or violate any municipal bylaws.
- Property Post Durham will not meet with an agent at the property at a specific time.
- Property Post Durham will not schedule any timed orders.
- In an event where a sign is requested on condominium property, the real estate agent and/or broker is required, prior to submitting their order, to gain permission for a sign installation from the condo corporation and notify Property Post Durham where a post can be placed.
- It is the full responsibility of a real estate agent and/or broker to inform Property Post Durham of any structural and/or infrastructural concerns including but not exclusive to: sprinkler systems, telephone or internet cables, unmarked gas lines, unmarked plumbing – at the property. Property Post Durham is not liable for any damages to the property as a result for neglecting to offer all pertinent information about the respective property.
- Property Post Durham may paint posts with latex paint to ensure the best presentation possible for the real estate agent and/or brokers. There may be wet paint on our posts for a short period of time after the post-installation. It is the responsibility of the real estate agent and/or broker to identify and notify all relevant parties of this wet paint, especially where an allergy to latex is of concern.
- Materials owned by Property Post Durham are NOT to be altered in any way. This includes but is not limited to: removal, reinstallation, relocation, and stickers. We reserve the right to determine all additional charges to your invoice and base our decision on operation costs.
- All installation orders are subject to an automatic “extension” fee of $10/month after the initial 120 days if a removal order has not been submitted on time. Extensions are NOT prorated.
Removals:
- Property Post Durham will not send confirmation to the real estate agent and/or broker when an order has been removed.
- In an event where the real estate agent and/or broker does not specify on the order that they would like the sign, riders, or any other materials that may have been used on the sign or post, then all materials will be taken back to Property Post Durham warehouse.
- In the event that Property Post Durham arrives at a property and notices significant damage to the real estate agent and/or broker’s sign, We will notify the relevant party of the damages, and we will store the sign until further advisement from the real estate agent and/or broker.
- In the event that a post is damaged or missing the real estate agent and/or broker will be fully responsible for the $100 replacement cost of posts.
- If the post is no longer in the location it was originally placed by Property Post Durham, it is the responsibility of the agent and/or brokerage to specify the location in which the post has been moved (i.e. the side of the house). If we are not informed that the post has been moved, and our driver is unable to locate it upon arrival at the property, it will be the agent and/or brokerage’s responsibility to either return all materials owned by Property Post Durham to our Whitby warehouse or to place and pay for an order for us to return and retrieve the materials once their location has been determined.
